
Bret W. Eubank
Senior Counsel
Mr. Eubank has more than 20 years’ experience in construction litigation in all project types, commercial, mixed use and residential involving high end custom homes, multi-unit apartment and condominium complexes and single family residence projects comprising hundreds of plaintiff homeowner litigants. He has particular experience in stucco and concrete issues and successfully defended, in the first trial of its kind, allegations of sulfate attack and water to cement ratio manufacturing defect claims against the concrete supply industry. Mr. Eubank, through his representation of a drywall trade association, testified before committees of the California legislature and authored an amendment which successfully resulted in revisions to Civil Code Section 2782 delineating the enforceability of indemnity agreements in residential construction contracts.
Mr. Eubank is admitted to practice in California and Nevada as well as the United States District Courts for the Southern and Central Districts of California, the United States District Court for the District of Nevada and the United States Court of Military Appeals. An active member of the legal community, he is also the recipient of an American Bar Association Award for Professional Merit.
