Stutz Attorneys Secure Appellate Victory for College District

Partner William C. Pate and Senior Counsel Christina M. Cameron  successfully represented San Diego Community College District securing a Fourth Appellate District Opinion in favor of the District on all grounds. The decision, issued July 31, 2014 involved consolidated appeals from judgments in favor of the District in the underlying Superior Court Case which denied Plaintiff’s claim of Breach of Contract and Breach of Warranty against the District. The Plaintiff, Atlas-Allied Inc., alleged that project site conditions exceeded the contract price of its “lowest bid” award for construction of a fire suppression system on the District’s Miramar College Campus. The judgment in favor of the District was affirmed. The judgment was also in favor of Nolte Associates, Inc., the engineering firm that prepared plans and specifications for the project.  For the full opinion, read Atlas-Allied v SDCCD 4th Appellate (2014) (Super. Ct. No. 37-2010-0091274-CU-CO-CTL)
